These terms describe the ground rules for using Biomi’s website, mobile app, Apple Watch features, and related services.

1. Agreement and the service

Biomi creates changing environments of sound and light based on an intention you choose. Features may change, be limited by your device, or be unavailable in a particular country or release.
2. Eligibility and accounts
You must meet the minimum age required by the laws where you live. Biomi is not directed to children under 13, and we do not knowingly accept a child’s consent where local law requires parent or guardian authorization.
Some features may require an account. You agree to provide accurate information, keep your sign-in details secure, and tell us promptly if you believe someone has used your account without permission. You are responsible for activity on your account, except to the extent applicable law says otherwise.
3. Apple Watch and HealthKit
Apple Watch and HealthKit biofeedback is optional and requires the permissions shown by Apple. If you connect it, Biomi may use permitted live readings such as heart rate, heart-rate variability, and, where enabled, oxygen saturation to adapt an active audiovisual session. Details are in our Privacy Policy.
You can decline or revoke those permissions. Biomi is not a medical device or healthcare provider. The Service does not diagnose, treat, cure, prevent, or monitor a disease, and it is not a substitute for professional medical advice.
Use the Service safely.
- Do not use Biomi while driving, operating machinery, or doing anything that requires your full attention.
- Use headphones and speakers at a comfortable, safe volume.
- Biomi includes moving and changing visual content. Stop if you feel discomfort, dizziness, or other symptoms, and seek professional advice if you have a health concern.
4. Purchases and subscriptions
If Biomi offers paid features, the price, billing period, renewal terms, trial terms, and refund rules will be shown before purchase. Do not rely on a price or offer that is not displayed at checkout.
Purchases made through Apple are billed and managed through your Apple ID and are also subject to Apple’s applicable terms. You can manage or cancel an Apple subscription through your Apple account settings. Any consumer cancellation or refund rights that cannot legally be excluded remain available.
5. Your license to use Biomi
Subject to these Terms, we give you a limited, personal, non-exclusive, non-transferable, revocable license to use the Service for your own non-commercial purposes. This license ends when your right to use the Service ends.
You may not:
- copy, resell, rent, lease, sublicense, or commercially exploit the Service;
- reverse engineer, decompile, or try to extract source code except where applicable law permits it;
- remove ownership notices or misuse Biomi’s name, marks, audio, visuals, or other content;
- upload malware, interfere with the Service, bypass access controls, or use automated scraping without written permission; or
- use the Service unlawfully or to infringe another person’s rights.
6. Your content and feedback
You keep ownership of content you submit, such as feedback, text, or material you choose to share. You give Biomi a non-exclusive, worldwide, royalty-free license to host, reproduce, and use that material only as needed to provide, secure, support, and improve the Service. Do not submit confidential, unlawful, or another person’s personal information.
Feedback about the Service may be used without payment or attribution. You promise that you have the rights needed to submit anything you send us.
7. Ownership and third-party services
Biomi and its licensors own the Service, including its software, designs, audio, visual systems, trademarks, and documentation. Except for the limited license above, these Terms give you no ownership rights.
The Service may depend on Apple, hosting, authentication, payment, or other third-party services. Their terms and privacy notices may also apply. Biomi is not responsible for a third-party service that it does not control.
8. Availability, disclaimers, and liability
We work to keep Biomi available and useful, but the Service may be interrupted for maintenance, updates, device limitations, connectivity problems, or events outside our reasonable control. We may change or discontinue features with reasonable notice where required by law.
To the maximum extent permitted by law, the Service is provided “as is” and “as available,” without warranties that it will be uninterrupted, error-free, or suitable for a particular result. Nothing in these Terms limits a warranty or right that applicable consumer law does not allow us to exclude.
To the maximum extent permitted by law, Biomi will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or lost profits or data, arising from your use of the Service. Our total liability for claims relating to the Service will not exceed the greater of the amount you paid us for the Service in the twelve months before the event or [insert lawful liability floor]. These limits do not apply where the law does not allow them, including for fraud, intentional misconduct, or liability that cannot be limited.
9. Suspension and termination
